Explicit Consent Text

This is an English translation provided for convenience. The Turkish version of this text is the legally binding version; in the event of any discrepancy, the Turkish version prevails.

Effective date: This text is provided, within the scope of Law No. 6698 on the Protection of Personal Data ("KVKK") and Law No. 6563 on the Regulation of Electronic Commerce, solely for the purpose of obtaining consent for processing that requires explicit consent.

• Important notice: The consents set out below are entirely optional (discretionary); not granting them in no way prevents you from obtaining basic hosting, server or domain name services through arcnar.com. You may withdraw any consent you have given at any time, without stating a reason. For the general principles governing the processing of your personal data, please review the "Privacy and Data Protection (KVKK) Notice".

1. Consent to Commercial Electronic Messages

Within the scope of Law No. 6563 and the Regulation on Commercial Communication and Commercial Electronic Messages, I give my explicit consent to the sending of commercial electronic messages to me by email, SMS or similar electronic communication means regarding the services, campaigns, discounts, new product announcements and information provided by Berat Tayşı.

• Communication channels and right to opt out: This consent covers only the marketing activities specified above. The subscription can be terminated free of charge at any time via the opt-out link included in the messages sent, through the Message Management System (İYS), or by sending a notice directly to [email protected].

• Exception: Transactional emails sent within the scope of the performance of the contract and legal obligations — such as invoices, payment confirmations, service expiry, security alerts and technical outage notices — are not subject to this consent and will continue to be sent in any event for the duration of the service relationship.

2. Consent to Transfer of Personal Data Abroad

Where the selected location of the service I have ordered is abroad, or where the head offices of the infrastructure, server, cloud, domain registration, payment and email providers used are located abroad; I give my explicit consent to the transfer of my identity, contact and (where mandatory in domain registration processes) legal data to the relevant countries and international providers (e.g. OVHcloud, international registries and registration bodies, global email/error-monitoring infrastructures), in accordance with the provisions of Article 9 of the KVKK and the relevant legal exceptions.

• I am aware that, if I do not give this consent, I may only benefit from the basic service scope that is hosted solely in domestic locations and does not require integration abroad.

3. Consent to Publication of WHOIS Information

Where WHOIS privacy (ID Protection) is technically unsupported or legally mandated for the extension of the domain name I register, pursuant to national or international registration rules and policies (Registry/ICANN rules), I accept that my contact and application information will be published publicly in the relevant WHOIS databases. (Note: For domain extensions where it is possible, WHOIS privacy is kept active by default.)

4. Withdrawal of Consent and Rights

I may withdraw the consent I have given for any of the approvals above at any time by sending a written notice to [email protected] or through the privacy/communication settings section within the Customer Panel. The withdrawal of consent does not affect the validity of lawful processing carried out before the date of withdrawal.
